1. Acceptance of Terms

By accessing or using the website located at www.ohmyglass.ca (the "Site"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Site.

These Terms constitute a legally binding agreement between you and OhMyGlass Window & Door Repairs ("we," "us," or "our"), a window and door glass repair and replacement service operating in the Greater Toronto Area, Ontario, Canada.

2. About Our Services

OhMyGlass Window & Door Repairs provides window and door glass repair and replacement services, including but not limited to:

  • Broken or cracked glass repair
  • Foggy or sealed unit glass replacement
  • Emergency glass repair (24/7)
  • Free quotes for residential and commercial glass work

Our services are available across Toronto, North York, Vaughan, Richmond Hill, Markham, Mississauga, and the Greater Toronto Area.

3. Use of the Site

3.1 Permitted Use

You may use the Site for lawful purposes only and in a manner consistent with these Terms. You agree to use the Site to:

  • Obtain information about our glass repair and replacement services
  • Request a free quote by submitting your name, email, phone number, and postal code (and optional photos you choose to upload)
  • Contact us regarding service inquiries

3.2 Prohibited Use

You agree not to:

  • Use the Site in any way that violates applicable federal, provincial, or local laws
  • Submit false, misleading, or fraudulent information through any form on the Site
  • Upload unlawful, harmful, or infringing images or other content
  • Attempt to gain unauthorized access to any portion of the Site or its related systems
  • Introduce viruses, malware, or other harmful code to the Site
  • Use automated tools (bots, scrapers, crawlers) to extract content from the Site without our written permission

4. Quote Requests

4.1 No Contract Until Confirmed

Submitting a quote request through the Site does not constitute a binding contract or guarantee of service. A quote is an estimate only. A service agreement is only formed when we provide you with a written confirmation of service scope, pricing, and scheduling, and you expressly accept it.

4.2 Accuracy of Information

You are responsible for providing accurate and complete information when submitting a quote request. We are not responsible for errors or delays resulting from inaccurate information you provide.

4.3 Quote Validity

Unless otherwise stated in writing, quotes provided by OhMyGlass Window & Door Repairs are valid for 30 days from the date of issuance. Prices are subject to change after the quote expiry date, or if the scope of work changes.

5. Intellectual Property

All content on the Site — including text, images, graphics, logos, icons, videos, and software — is the property of OhMyGlass Window & Door Repairs or its content licensors and is protected by applicable Canadian and international intellectual property laws.

You may not reproduce, distribute, modify, publicly display, or create derivative works from any Site content without our prior written permission, except for personal, non-commercial use (e.g., saving a page for your own reference).

The OhMyGlass Window & Door Repairs name, logo, and associated marks are trademarks of OhMyGlass Window & Door Repairs. Nothing on the Site grants any right or license to use any trademark without our express written permission.

6. Disclaimer of Warranties

THE SITE AND ITS CONTENT ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES INCLUDING, BUT NOT LIMITED TO:

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE ONTARIO AND CANADIAN LAW, OHMYGLASS AND ITS OWNERS, EMPLOYEES, CONTRACTORS, AND AGENTS SHALL NOT BE LIABLE FOR:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, revenue, data, goodwill, or business opportunities
  • Damages arising from your use of or inability to use the Site
  • Errors or inaccuracies in Site content, including quote estimates

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO YOUR USE OF THE SITE SHALL NOT EXCEED CAD $100, OR THE AMOUNT YOU PAID US FOR SERVICES IN THE 30 DAYS PRECEDING THE CLAIM, WHICHEVER IS GREATER.

Nothing in these Terms limits liability that cannot be excluded under applicable law (such as fraud or gross negligence).

8. Third-Party Links and Services

The Site may contain links to third-party websites or services. These links are provided for your convenience only. We have no control over the content, privacy practices, or availability of external sites and assume no responsibility for them. Accessing third-party sites is at your own risk.

9. Privacy

Your use of the Site is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Site, you also agree to the collection and use of your information as described in the Privacy Policy.

10. Indemnification

You agree to indemnify, defend, and hold harmless OhMyGlass Window & Door Repairs and its owners, employees, contractors, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with:

These Terms are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles.

Any disputes arising out of or relating to these Terms or the Site shall be subject to the exclusive jurisdiction of the courts located in Toronto, Ontario, Canada. You hereby consent to such jurisdiction.

13. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable under applicable law, that provision shall be deemed modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.

14. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and OhMyGlass Window & Door Repairs with respect to your use of the Site, and supersede all prior or contemporaneous understandings, agreements, or representations.
